Terms of Service
Effective October 10, 2025
These Terms of Service (“Terms”) govern your use of the ThreeFive website and the design and related services provided by THREEFIVE CREATIVE LLC (“ThreeFive,” “we,” or “us”). By using our site or engaging us for services, you agree to these Terms. A specific project may also be covered by a separate proposal or agreement; if a signed agreement conflicts with these Terms, the signed agreement controls.
Our services
ThreeFive provides website design and build services — primarily on Webflow — along with optional ongoing support and marketing services. The scope, timeline, and price of a project are confirmed with you before work begins.
Payment and deposit
A 50% deposit is required before we begin, and your project is scheduled once we receive it. The remaining balance is due as set out in your proposal, typically before your site is launched or handed over.
Refunds and cancellations
When you book a project, we reserve time and resources specifically for you. For that reason, deposits and payments are non-refundable, and a project cannot be cancelled for a refund once work has begun. If your circumstances change, please reach out — we’re glad to talk through options, and any alternative arrangement is made at our discretion.
Ongoing service and maintenance
After launch, your website is offered with a standard monthly service plan. It includes managed hosting, an SSL security certificate, regular backups, software and security updates, and uptime monitoring — all handled for you through Webflow’s infrastructure. The plan also includes up to five (5) hours per month of update requests, such as updating information, swapping photos, or posting blog updates.
Update requests beyond five hours in a given month, or larger changes such as new pages, new features, or a redesign, are quoted and invoiced separately.
Choosing not to continue the plan
The monthly plan is optional. If you choose not to continue it, we will hand the website over to you, and you will be responsible for your own Webflow site subscription and for hosting, security, and maintenance going forward. Without an active plan, ThreeFive is not responsible for hosting, updates, or support.
Branding
ThreeFive may include a small credit — for example, “Built by ThreeFive” — in your website’s footer.
Ownership and intellectual property
Once your project is paid in full, you own the final design and content we create for your business. Third-party components — including fonts, stock assets, plugins, and the underlying platform (Webflow) — remain subject to their own licenses. ThreeFive may display the completed work in its portfolio and marketing.
Your responsibilities
You agree to provide accurate information and any content or access we need (text, images, logins) in a timely way, and confirm that you have the rights to any materials you give us.
Acceptable use
You agree not to misuse our website, including attempting to breach its security, disrupt it, or use it for any unlawful purpose.
Third-party services
Our website and the sites we build may rely on or link to third-party services such as Webflow, Calendly, and Google. We are not responsible for the content, policies, or practices of third parties.
Disclaimers
Our services and website are provided “as is.” We put real care into our work, but we do not guarantee specific business outcomes such as search rankings, traffic, or revenue.
Limitation of liability
To the fullest extent permitted by law, THREEFIVE CREATIVE LLC is not liable for any indirect, incidental, or consequential damages. Our total liability for any claim is limited to the amount you paid us for the services giving rise to that claim.
Governing law
These Terms are governed by the laws of the State of Hawaii, USA, without regard to its conflict-of-law rules. Any disputes will be handled in the courts located in Hawaii.
Changes to these Terms
We may update these Terms from time to time. The effective date above shows the current version.
